Results Oriented Litigation Services.
For more than 25 years, litigators with The Walsh Firm, PC have represented plaintiffs in employment and consumer class actions, including classes of consumers, residential tenants, employees and independent contractors. These are not "everyone gets a coupon for $3 off a purchase of $10 or more" settlements. We recover real money, sometimes thousands of dollars per claimant, from corporations that have been ignoring their legal obligations to their workers and customers.
Individuals are often taken advantage of by large monied corporations who can more easily afford to pay lawyers to defend their interests in court, and who can play the odds, knowing that the number of individuals who sue to protect their rights will be small, and that some of whose who sue will lose. Even the most protective consumer laws don't help individuals who are cheated into small losses, because in many instances, most consumers don't have the time, money or energy to fight back, and some don't even know they have the right to fight back. Companies know this, and often violate the law deliberately, knowing that the money they save by breaking the law will always be more than the cost of settling the claims of only the most diligent consumers.
Class actions help to level this playing field by allowing consumers, tenants, workers and other groups of individuals to aggregate their claims, making it cost-effective to pursue these claim, and empowering the individual with legal representation that is as experienced and effective as that of the largest corporations. In fact, many successful class action plaintiffs lawyers, including us, got their start by representing some of the world's largest corporations.
We've successfully prosecuted class action cases on behalf of classes as small as a few dozen, and as large as tens of thousands, with settlements and judgments ranging from a few hundred thousand dollars to more than ten million dollars. The cases we've accepted include landlords improperly withholding rent deposits, retailers misrepresenting their products, and employers failing to pay overtime, making employees work off the clock, denying meal breaks and rest breaks, failing to pay final wages upon termination, charging workers for tools and uniforms, or compelling workers to patronize their employer's business.
We've represented classes of claimants in California state courts, U.S. District Court, and in arbitration. We are aggressive and persistent. We have successfully represented each class whose victories were challenged on appeal, and in the one and only instance in which lost at the trial court level, we appealed and not only won the appeal and fought off a petition for Supreme Court review, but we went on to win a $3 million settlement.
While these cases can take a long time to resolve, typically, once certified, the result in very large recoveries for the class members, either by settlement or verdict, and as an added bonus, they usually result in a change in corporate conduct that benefits everyone who deals with that corporation in the future. Some of these cases quite literally make the world a better place. And we do it without our clients paying legal fees up front. We work these cases on a contingent fee basis, we advance the litigation expenses, and we don't recover a dime unless we succeed and collect money for the class from the defendant.
